Snohomish County Sheriff Adam Fortney’s fight against recall petitions started by residents who were angered when he posted to Facebook that he would not enforce COVID-19 restrictions has suffered a hit in court, My Edmund News reported.
Fortney had sought to have an Juan County Superior Court Judge Kathryn Loring reverse her previous ruling to permit the recall petitions, but Loring rejected the motion.
The case is being dealt with in San Juan County due to conflict of interest concerns.
Fortney made the post in April stating his intent to not enforce stay-at-home orders from Gov. Jay Inslee, which he considered unconstitutional, and some local residents charge doing so violated his oath of office, according to My Edmund News.
Those circulating the petitions also charge that Fortney’s words incited others to defy Inslee’s order.
But the recall petitions also air additional grievances against Fortney beyond anything related to the coronavirus, including claims he hired back deputies who had been fired for misconduct, My Edmund News reported.
